AttaPoll Terms & Conditions: User Agreement for Paid Surveys

Terms & Conditions

1. Acceptance of these Terms

By registering for, accessing or using the AttaPoll mobile application, web application, website or any other AttaPoll-branded service (together the “App”) you enter into a binding contract with AttaPoll Ltd, a company registered in England and Wales (company number 10042842) whose registered office is 60 Cannon Street, London EC4N 6NP, United Kingdom (“AttaPoll”, “we”, “us”, “our”). If you do not agree, do not use the App.

If this document is presented in any language other than English, this translation is provided solely as a courtesy. In all cases, the English version shall be decisive regarding any interpretation of the text.

2. Definitions

Activities – Any way of earning within the App including Surveys, Games, Tasks, Advertising Interactions, Location-Based assignments, Promotions and Referrals.

Panelist/User/you – An individual who has created an AttaPoll account.

Rewards – Cash, vouchers, credits or other consideration offered for completing Activities.

Referral Terms – The referral programme rules described in our Referral Terms page.

Activity Owner – A third party that commissions an Activity.

Minimum Withdrawal Threshold – The minimum confirmed balance (displayed in-App) required before a cash-out request can be processed.

3. Eligibility

You must be at least 13 years old to register for or use the App. If the minimum legal age in your country to use online services is higher than 13, then that higher age applies.

If you are under 18 years of age (or under the legal age of majority in your jurisdiction), by accessing or using the App you confirm, represent and warrant that:

you have reviewed these Terms with your parent or legal guardian; and
your parent or legal guardian consents to your use of the App and your participation in AttaPoll Activities.

If we become aware that a user is under 13, or under the applicable minimum age in their jurisdiction, or lacks valid parental consent, we may terminate access, deactivate the account, and delete personal data in accordance with our Privacy Policy.

You must also have legal capacity to enter into a contract under the laws of England and Wales. If you do not meet this requirement, or if any applicable laws prohibit your use of the App or receipt of Rewards, you may not use the App.

We may request verification of your age, location, phone number or identity:

where required by law; or
to prevent fraud or misuse.

Failure to cooperate with such requests may result in suspension, forfeiture of Rewards and/or account closure.

4. Overview of AttaPoll Activities

AttaPoll allows you to earn Rewards by carrying out Activities such as:

Surveys – answering research questionnaires;
Games – playing games;
Tasks – registering for and using new products and services, sharing shopping activity, product-testing or other micro-assignments;
Advertising Interactions – viewing, clicking or engaging with advertising or sponsored content;
Location-Based Services – Activities that require you to be in a specified geographic area (device location services must be enabled and accurate);
Promotions – limited-time bonus offers published in the App;
Referrals – earning under the Referral Terms.

Each Activity may include additional rules shown on-screen. Starting an Activity signifies acceptance of those rules.

Activities are made available by either:

AttaPoll, or
third-party Activity Owners (e.g. advertisers, researchers, product developers).

When an Activity is provided by a third-party Activity Owner:

The Activity is sourced, powered, and controlled by that third party, not AttaPoll.
AttaPoll acts solely as a facilitator to give you access to their content or offer.
Your participation in that Activity constitutes a direct interaction between you and the third-party provider, not AttaPoll.
The third party’s own terms and conditions, privacy policy, and rules may apply – which you should review and agree to before continuing.
Any data or content you submit within that Activity may be stored by the third party as required for the Activity’s operation, validation, or fraud prevention.

AttaPoll does not guarantee the availability, accuracy or suitability of any third-party Activity, nor does it accept liability for the performance or fulfilment of any third-party offer.

5. Account Registration, Security and One-Account Rule

Provide accurate, current and complete information at all times. Only one active account per natural person is permitted. Creating or operating multiple accounts is prohibited and constitutes fraudulent behaviour. You are responsible for keeping login credentials secure and for all actions taken through your account.

If you provide information that is false, inaccurate, incomplete, outdated or misleading, or refuse to verify details when reasonably asked, AttaPoll may, without prior notice and at its sole discretion, take any or all of the following actions:

Disqualify you from the Activity and withhold or cancel Rewards;
Reverse Rewards where fraud is proven;
Suspend or permanently close your account;
Forfeit any unwithdrawn balance;
Bar you from future participation in some or all Activities;
Recover any losses, costs or damages resulting from the misrepresentation; and/or
Report the matter to Activity Owners, payment providers, regulators or law-enforcement agencies.

6. Rewards & Withdrawals

Earning

Rewards are credited only when an Activity is verified as successfully completed by AttaPoll and/or the relevant third-party Activity Owner.

For third-party Activities, the Activity Owner has sole discretion to decide whether you met all completion criteria. Their decision is final, and AttaPoll cannot credit any Reward unless and until that confirmation is received. This may result in a delay between completing an Activity and seeing the Reward in your account.

AttaPoll also reserves the right to deny, withhold or reverse any Reward if:

the Activity Owner reports that you did not meet the required conditions;
the advertiser or third party withholds or reverses payment; or
the Reward was issued in error or based on inaccurate or incomplete information.

The amount of Reward available for each Activity varies and is displayed within the App before you begin. This is the only Reward AttaPoll agrees to offer for that Activity.

Any additional offers, bonuses or incentives that may be:

shown within the Activity itself;
stated by a third party; or
promoted in advertising or communications not issued by AttaPoll;

are not made by AttaPoll, and we are not responsible for fulfilling them.

Withdrawal

You may request a withdrawal once your confirmed balance exceeds the Minimum Withdrawal Threshold, which varies by country and payment method.

These thresholds are displayed in the App and may be updated from time to time at our sole discretion and without prior notice.

We may, at our discretion, allow a one-off withdrawal below the Minimum Withdrawal Threshold and deduct a processing fee of £3 from the withdrawal amount.

Withdrawals are paid only to payment accounts that are owned and operated by you. You may not request payment to any account held by another person or entity.

You are responsible for ensuring that your payment account details are correct and valid. If a withdrawal is returned, rejected, misrouted or lost due to incorrect or incomplete payment information provided by you, we may deduct any resulting administrative or tracing fees from your balance.

Dormancy

If you have no Activity for a continuous period of six (6) months, your Rewards will be forfeited and your account closed.

For the purposes of this section, Activity means the successful completion of any survey, game, task, offer, or other earning opportunity displayed in the App that results in a recorded entry in the Activity section of your account. Merely opening or logging into the App, without completing such an Activity, does not reset the dormancy period.

Taxes

You are solely responsible for declaring and paying any taxes, duties or other charges that may apply to the Rewards you receive. AttaPoll does not provide tax advice, and we recommend you seek guidance from your local tax authority if you have any questions.

7. Advertising, Offers & Third-Party Content

Advertising messages, promotional links, tasks and game offers are provided by third parties. We do not warrant their accuracy or availability.

Your dealings with advertisers or other third parties (including payment and delivery of goods or services) are solely between you and that third party.

8. Location-Based Services

When you opt-in to a location-based Activity, the App collects and shares precise location data with the relevant Activity Owner. Location data is processed in accordance with our Privacy Policy.

9. Referral Programme

Referral bonuses are governed by the Referral Terms which form part of these Terms by reference. If there is a conflict, the Referral Terms prevail for referral matters.

10. User Conduct

You agree not to:

Interfere with or disrupt the App or any networks connected to it;
Use automated scripts, emulators, VPNs, adblockers or other techniques to manipulate your device, identity, location or Activity eligibility;
Upload viruses or malicious code;
Copy, decompile or reverse-engineer any AttaPoll software;
Use the App for any unlawful purpose.

11. Controls & Quality Checks

We employ timers, duplicate / attention-check questions, open-text screening, device information gathering and geo-fencing to ensure data quality and detect fraud. Failure to pass these controls may result in disqualification, non-payment of Rewards and/or account termination.

12. Suspension & Termination

We may suspend or terminate your account immediately (and cancel unpaid Rewards) if you:

breach these Terms or any Activity-specific rules;
engage in fraud, abuse or any activity that harms AttaPoll, its clients or other users;
fail an identity, phone number, location or age verification request.

You may close your account at any time from within the App’s Profile or Settings menu.

13. Intellectual Property & Confidentiality of Activity Content

Ownership

Unless expressly stated otherwise, all code, concepts, text, designs, graphics, photographs, video, audio, trademarks, service marks, trade names and the selection or arrangement thereof (collectively “Content”) contained in the App or within any Activity are protected by intellectual-property laws worldwide and are owned by, or licensed to, AttaPoll, its affiliates or the relevant Activity Owner.

Limited Licence to Participate

AttaPoll grants you a personal, non-exclusive, revocable, non-transferable licence to access the App and the Content only for the purpose of completing Activities in accordance with these Terms. No other rights are granted.

Prohibited Acts

You must not, and must not allow any other person to:

Copy, record (including by screenshot or screen-capture), download, store, transmit, publish, distribute, display, sell, license, reverse-engineer, decompile or modify any part of the Content;
Share or disclose survey questions, creative assets, prototypes, game mechanics, advertising copy or any other materials made available through an Activity;
Use the Content to create derivative works or to build a competing product or service.

Confidentiality and Non-Disclosure

Many Activities include proprietary or pre-release material that constitutes trade secrets and commercially sensitive information of AttaPoll or third-party clients. You acknowledge a duty of confidentiality and agree not to disclose such information to any person, platform or medium, whether during or after your use of the App.

Enforcement

Unauthorised use or disclosure of the Content is a material breach of these Terms and may result in:

Immediate disqualification and loss of Rewards;
Suspension or termination of your account;
Civil proceedings for injunctive relief, damages and costs; and/or
Criminal prosecution where applicable.

AttaPoll will cooperate with rights-holders and law-enforcement authorities to protect intellectual property and confidential information, including by disclosing your account details where legally required.

14. Privacy

Personal data is processed in accordance with our Privacy Policy, which explains what we collect, why and how you can exercise your rights.

15. Disclaimers

The App and all Activities are provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, satisfactory quality, fitness for a particular purpose and non-infringement. We do not guarantee that the App or Activities will be uninterrupted, secure or error-free.

16. Limitation of Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be legally excluded.

Subject to that, our total liability to you for any claim relating to the App, an Activity or these Terms is limited to the greater of:

£100; or
the total amount of Rewards actually paid to you in the 12 months before the claim arose.

We are not liable for any indirect or consequential loss, or for loss of profits, business, goodwill, or data.

17. Indemnity

You agree to indemnify, defend and hold harmless AttaPoll, its directors, officers, employees, agents, affiliates and partners from and against any and all claims, demands, liabilities, damages, losses, costs and expenses (including reasonable legal and professional fees) arising out of or in connection with:

your use of the App or participation in any Activity;
your violation of these Terms or any applicable law or regulation;
any content or information you submit or transmit through the App;
any claim by a third party arising out of your conduct, including (but not limited to) unauthorised disclosure of confidential Activity content, misuse of Rewards, or improper use of another person’s payment account.

This indemnity obligation survives the termination of your account and your use of the App.

18. Changes to the App or the Terms

We may modify, suspend or discontinue any part of the App or these Terms at any time. Material changes will be notified in-app or by email. Continued use after the effective date constitutes acceptance.

19. Severability & Assignment

If any provision is found unenforceable, the remainder shall remain in full force. You may not assign or transfer your rights under these Terms without our written consent; we may assign them without restriction.

20. Governing Law & Jurisdiction

These Terms (and any non-contractual obligations arising out of them) are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction to settle any dispute.

21. Contact

If you have a question or issue related to an Activity or your account, please use the in-app Help screens to contact us. This allows us to respond more efficiently and ensures we have the information needed to support you.

If you’re unable to access the App or need to reach us for another reason, you can email us at info@attapoll.com.

Your account will be credited with the incentive or incentives, displayed in our App, on the Invite Friends screen, for each valid user that installs the AttaPoll Android or iOS application using your unique referral link.

If the user being referred did not install the app using your unique referral link, they may alternatively enter your referral code in the Settings page of their app within 7 days of becoming a user. Users that installed the app from another source, such as an ad or marketing campaign may not be considered a valid referral.

The incentives shown apply only to referred users that are in the same country as you signed up in.

We determine the country that a user is joining from, at our sole discretion. If the user being referred is in a different country than the one you signed up from, you may get a reduced incentive or no incentive at all. If the user being referred is in a different country than the one you signed up from they may also get a reduced incentive or no incentive at all.

For incentives where you are entitled to a percentage of your referral’s earnings, only earnings from completed surveys, having the transaction status “Survey Complete” will be considered. You will not receive a percentage of your referral’s other earnings such as from their referrals, goodwill or bonuses. Incentive amounts less than GBP 0.10, or other currency equivalent, may be accrued and added to your account when they exceed this amount.

Incentives are only paid to users whose accounts are in good standing and are not suspended or blocked.

Users must be 18 or over and live in a supported country. We may, at our sole discretion, consider users under this age valid for the purposes of this referral program.

We only pay for real users that pass our quality checks and complete the signup process. Our decision on the validity of a referral is final.

When promoting the app by sharing your referral code or link you are obliged to provide accurate information about the app and the referral program. We will not be held responsible for the accuracy of the statements you make. Promoting your referral code or link using misleading information or false advertising about the app or the referral program will result in the removal of any incentives you may have been awarded. In addition, you may no longer be eligible to participate in the referral program and your account may be terminated.

You must be using the latest version of the AttaPoll app downloaded from the Google Play Store or Apple App Store to see the incentives applicable to you. Use of an older version of the App or an App downloaded from any other source may result in out-of-date or inaccurate information being presented to you, such incentives might no longer be valid and cannot be paid.

Inviting friends using the app uses your device’s other apps to send the invite. We are not responsible for any charges you incur.

We reserve the right to alter or withdraw this referral program at any time, without prior notice, and at our sole discretion.
